Loss mitigation / Loss control
WFP has an obligation to prevent damage and a legal duty to mitigate, or reduce, losses. Failure to do this, compromises the possibility of recovery from carriers, or other insurers. Evidence of the mitigation of damages is an essential part of a claim against carrier.
LEGM - Legal Maritime service - is the focal point for all matters relating to packaging, storage and fumigation, and is responsible for providing guidance on reconditioning, repackaging and destruction of damaged commodities. LEGM works with, and advises, the Country office (CO) in all aspects of the prevention and reduction of loss, whenever necessary. LEGM co-ordinates with relevant Institutes and has established a system for the analysis of damaged cargo.
The Country Office should always inform LEGM immediately when there is major loss or damage
